There are a number of instances where you may need to consider hiring a family law attorney. While most people think of a family attorney to help with adoptions or to write a will, there are other cases where the services provided are necessary. When you are in need of any of these services, it's a good idea to contact a Troy Michigan attorney who specializes in family law.

Prenuptial agreements - whether this is your first marriage or you were previously widowed or divorced, a prenuptial agreement can save numerous problems later. Whether the agreement simply specifies which assets belong to which spouse or contains language protecting children of prior marriages, a family law attorney can ensure the agreement is written in accordance with Michigan laws

Annulment of marriage - too often, people believe the amount of time they were married will determine whether or not they are legally able to obtain an annulment. There are very limited cases such as a person being legally married to another person or other forms of fraud which may enable you to have your marriage annulled

Divorce actions - while Michigan does allow a "no fault" divorce, there are residency requirements that must be met. Fortunately, both parties do not have to meet the requirement, only one is necessary

Property division as a result of divorce - when you do not have a prenuptial agreement, it is important to have a family law attorney assist with marital property division. Your rights should be protected by someone who is representing your interests

Alimony/Child support - during the negotiation period of preparing to file for divorce, spouses generally feel they should not have to pay any type of "after divorce support". However, Michigan has specific criteria for determining spousal support. Child support is generally ordered by the courts payable to the custodial parent. Michigan Child Support Formula is used to determine the amount. Under the law, child support must be paid until the child reaches age 18 and may be payable until they are 19 1/2 if they are still in high school and attending full-time

Modification of support orders - in some cases, it may be necessary to request the court review child support or spousal support payments. Reviews are typically requested when the supporting parent loses their job or when they get a long-term increase in their anticipated income. Keep in mind, modifications can occur any time after the initial order

Regardless of whether you are single and attempting to establish paternity or write up a prenuptial agreement or you are in the midst of a divorce, a family law attorney may be necessary. The court system can be very overwhelming and each of these issues is emotional for both parties. It is important to always have an attorney review any agreements you reach with a spouse or unmarried partner before you make a final decision.
