Lathrup Village Family Law

Cases pertaining to family law form a significant portion of the court cases filed all over the country, and the statistics for Lathrup Village, Oakland County, Michigan are similar. Lawyers specializing in family law have acted on behalf of their clients either to get an out of court settlement of the case or fought the case in the family court.

Marriage has certain legal implications as the wife gets a stake in the assets of the husband, and becomes the legal heir to the assets and vice versa. Divorce is the official annulment of a marriage by the court. When both partners agree that the marriage has broken down irretrievably, and there is no point in continuing, they may agree to divorce, so that both partners can start life anew.

In some cases, the husband may not agree to the divorce since he will have to pay spousal support to the wife, especially if she has been a housewife looking after the house. In such cases, the wife will have to contact a divorce lawyer to get a divorce. Child Custody is often a contentious issue during a divorce. If there are one or more children, both the husband and wife may want custody of the children after the divorce, so that they can bring up the child or children as they wish.

Though the mother is usually given custody of very small children, the father may object to this arrangement, especially if his wife remarries or has a boyfriend who is not treating the children well. If the child custody dispute is not settled amicably out of court, a legal battle will have to be fought in court. Child support to take care of the expenses involved in bringing up the children could also be disputed by either spouse.

Property Division is often the subject of dispute as well as concealment during a divorce. A wife has a right to a share of the property which has been purchased by the spouse during the marriage, more so if she has been a housewife attending to all household chores and domestic problems, so that the husband can concentrate on his career.

While some husbands may readily share the information about the property assets owned by them, there are others who will conceal these assets, so that their wife does not get a share. In such cases, the wife may have to hire a detective to trace the assets.

The disagreements during divorce can be greatly reduced if both the husband and wife agree to sign prenuptials before marriage. For high profile marriages, the chances of divorces are much higher, and since high values assets are involved, most lawyers advise that the couple prepare a prenuptial agreement, which clearly demarcates the assets and liabilities of each partner. It will also ensure that there are less unpleasant disputes in case of a divorce.

The services of a family lawyer may also be needed for getting a paternity test done, to decide who the real father of a child is. Many times, the real father of a child may shirk responsibility, and not be willing to pay the child support needed to bring up the child. The family lawyer can help the mother get a court order to conduct the paternity test, and then use the results to get the necessary child support.
